Shelby County District Attorney appeals court decision to release Railgarten Circle shooting suspect without bail

MEMPHIS, Tenn. (WMC) – The Shelby County District Attorney’s Office filed an emergency motion Wednesday morning appealing the court’s decision to release 30-year-old Detawn Gunn without bail on Monday.

Gunn is accused of firing a shotgun outside the popular Midtown hangout Railgarten on Friday, August 16.

The affidavit alleges that Gunn targeted a guest after a dispute over his parking space. That victim and three passersby were struck by bullets.

Gunn was on the run for five days before being arrested. He is charged with 12 felony counts: five counts of attempted second-degree murder, five counts of use of a firearm in the commission of a dangerous felony, and two counts of vandalism of property valued between $1,000 and $2,500.

A judicial commissioner initially set Gunn’s bail at $500,000, and prosecutors argued for that amount to be kept.

District Attorney Steve Mulroy, however, called the move disappointing: Judge Bill Anderson approved Gunn’s release on parole.

Also on Wednesday, State Senator Brent Taylor (R-Memphis) wrote a letter to the Tennessee Board of Judicial Conduct calling for disciplinary action against Judge Anderson over the decision.
