Hotel faces building ban in Palm Beach because of road built without permit

The Brazilian Court Hotel was hauled before the Code Enforcement Board for the second time this year after a local resident alerted officials to a small gravel road that had been built without proper permits.

Ironically, the latest violation was part of the hotel’s efforts to correct another building code violation committed earlier this year related to the hotel’s gate, Building Code Commissioner John Moriarty told the board during its Aug. 15 meeting.

This case, too, was fueled by a resident’s complaint and resulted in the hotel having to pay a total of $1,800 in administrative fees and fines for a defective gate designed to enclose the hotel’s garbage cans.

According to city ordinance, commercial businesses are required to cover their garbage cans so that they are not visible to the public.

However, this did not happen because there is a bike rack for state and employee bikes behind the gate, Moriarty said.

“To at least fix that part of the problem, Brazilian Court in good faith laid this gravel path with pavers … outside the wooden gate,” he said. “However, they did not apply for a permit or a building permit from ARCOM (Architectural Commission).”

According to Moriarty, the hotel submitted an application to the Architectural Commission on June 24, but has not yet received a hearing date or approval for the gravel path on the southwest corner of the property.

No representative of the Brazilian Court Hotel attended the meeting.

Without comment, the board unanimously voted to impose a $150 administrative fee and required the hotel to comply by September 16. Otherwise, the Brazilian Court Hotel will face a hearing on the amount of the fine during the board meeting on September 19.

The Brazilian Court Hotel did not respond to a call seeking comment on Wednesday.
